Terms
The deal, in plain words.
These terms apply when you order from Metal Sign Designs. We have written them to be read rather than skipped, because a sign cut to your family name is not a good place for a surprise.
Who You Are Dealing With
Metal Sign Designs, trading from New Zealand. Contact us at [email protected].
Placing an Order
Adding something to your basket is not an order. Your order exists once payment goes through, and our confirmation email is us accepting it.
We can decline an order. That is rare, and the reasons are honest ones: we cannot make the item, the address is one we cannot ship to, the payment looks fraudulent, or a price was listed wrong by an obvious margin. If we decline after taking payment, you get all of it back.
Prices
All prices are in United States dollars and include shipping. Your bank may charge a currency conversion fee, which is between you and them.
Prices can change, but never after you have ordered. What you paid is what you agreed to.
Finishes and Sizes
The finish swatches on a product page are screen approximations of a physical powder coat. They are not color managed, and no screen can be. Treat them as a guide to which finish you want rather than as a color match to a paint chart.
Sizes are the longest dimension of the sign. A shape that is wider than it is tall measures across, so check the size against your wall before ordering rather than after.
The Wording You Choose
A family name sign is cut with the surname and wording you select, exactly as the option is written. Please read your selection back before you order, because a cut sign cannot be re-cut into a different name.
We will not cut anything abusive, hateful, threatening, or that uses someone else's trade mark. If you order something we will not cut, we cancel it and refund you in full.
Delivery
Shipping is free within the United States, and the United States is the only place we ship. Every sign is made after you order, so allow 5 to 11 business days in total, made up of the time in the workshop and the rest in transit.
Those are estimates, not guarantees, and once a parcel is with the carrier its timing is out of our hands. If a sign has to arrive by a particular date, order with room to spare and tell us the date so we can flag it.
Where the Sign Can Go
These are made for indoor walls and covered outdoor spaces. Powder-coated steel left in standing water or full weather will eventually mark, whatever the coating, and that is not a fault we can remake for. Our returns page says the same thing at more length.
If Something Goes Wrong
Our returns and refunds page sets out what we do about a sign that arrives damaged, faulty, wrong or not at all, and what happens if you change your mind. It forms part of these terms.
Nothing here limits your rights under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986. Where those Acts give you more than these terms do, they win.
Our Designs
The artwork, lettering and photography on this site are ours. You are buying the sign, not the right to reproduce the design, and that includes reselling the cut file or the images.
What We Are Responsible For
If we get your order wrong we put it right, as the returns page describes. Beyond that our liability is limited to what you paid for the order.
Hanging is yours. Fixings vary by wall, and a large sign is heavy enough to matter, so use a fixing rated for the weight and the surface. We are not liable for damage caused by how a sign was mounted.
We do not accept liability for an occasion missed because a carrier was slow, which is why we ask you to order early and tell us the date.
Changes
We may update these terms. The version that applies to your order is the one published on the day you placed it.
Governing Law
These terms are governed by New Zealand law, and the New Zealand courts have jurisdiction. If you bought as a consumer somewhere else, this does not take away the protections your own country gives you.
